By letter dated December 15, 2009, the Minister of Energy, Mines and Petroleum Resources indicated that the Transmission Inquiry should be suspended until May 31, 2010. That letter was posted with other Transmission Inquiry exhibits as Exhibit A-35. On December 21, 2009, the Inquiry Panel issued Order G-167-09 (Exhibit A-37) suspending the Inquiry until May 31, 2010.
On April 28, 2010, the Government introduced in the Legislature The Clean Energy Act (Bill 17, 2010), which proposed to reintegrate British Columbia Transmission Corporation with British Columbia Hydro and Power Authority, and also proposed certain consequential amendments to the UCA. On May 31, 2010, the Minister wrote to the Commission stating that changes proposed in the Clean Energy Act eliminate the need for a Commission-led Inquiry and that a consequential amendment under Bill 17 proposed to repeal sections 5(4) to (9) of the UCA. The Minister's letter further stated that, assuming sections 5(4) to (9) of the UCA are repealed, the Inquiry would no longer be a legislated requirement and therefore resumption of the Inquiry would not be warranted. On June 3, 2010, the Clean Energy Act received Royal Assent resulting in the repeal of sections 5(4) to (9) of the UCA.
On June 4, 2010, the Commission issued Order G-98-10 cancelling the Inquiry. The evidence and other documents that were produced while the Inquiry was occurring can be found under the Completed Applications section of the Commission’s website.
